1. General

These terms and conditions (“Terms”) apply when you, as a consumer (“You”), place an order via AWCO (“The Company,” “we,” “us”) e-commerce platform. By completing an order, you accept these Terms.

2. Orders

When you place an order on our website, you confirm that you have read and understood these Terms. To place an order in the webshop, you must be at least 18 years old. A confirmation will be sent to the email address provided at the time of order. We reserve the right to correct any inaccuracies in product information, availability, or pricing on the website after an order has been placed. You will be notified promptly of any such changes and given the option to proceed or cancel your order.

If a product is out of stock before the inventory status is updated in the webshop, you will be notified via email. In cases of incorrect price information on the website, where you have either overpaid or underpaid, we will offer you the opportunity to purchase the product at the correct price, or you may cancel your order. AWCO reserves the right to reject or terminate a purchase agreement if there is suspicion of fraud or similar irregularities, such as unauthorized use of others' credit cards.

3. Prices and Payment

All prices on the website are listed in Euro including VAT. We collaborate with Klarna, which handles your personal data in accordance with the international PCI DSS security standard. Payment is made through the payment solutions specified on our website. If there are any delays or problems with payment, please contact us immediately.

4. Delivery

We offer deliveries in Sweden. Delivery times vary depending on the delivery method and product availability. The estimated delivery time is stated at the time of order. If a product is out of stock, you will be notified via email. If a product becomes unavailable before the status has been updated correctly in the webshop, you will be informed via email.

5. Right of Withdrawal and Returns

You have the right to cancel your purchase within 14 days from the date you received the product, in accordance with the Swedish Distance Selling Act. The product must not have been used beyond what is necessary to assess its condition, features, and function. If the product shows signs of use, a reduction in refund value may apply. The product must be returned in undamaged condition and in its original packaging.

Upon approved returns, the amount will be refunded to the same payment method used for the purchase within 5 days after we receive and inspect the returned product. A return fee of 49 SEK will be charged.

Exchanging a product for a different size is free of charge, provided you use the return shipping label we send out. Free exchanges apply only to size changes. For exchanges involving a different product, please place a new order and follow the return process. Fill in the return form with the size you wish to exchange for and follow the return instructions. Once we have received your item, we will ship the product you have chosen in exchange.

6. Complaints

If a product is defective or damaged upon delivery, you have the right to file a complaint. Contact us as soon as possible, but no later than 14 days after receiving the product. For approved complaints, we will cover the return shipping cost and offer either a replacement product or a refund.

7. Personal Data

We handle your personal data in accordance with GDPR (General Data Protection Regulation). By placing an order, you agree that we store and process your personal data to fulfill our obligations to you. You have the right to request at any time that your personal data be corrected or deleted.

8. Limitation of Liability

The Company shall not be held liable for damages arising from improper use of the products, negligence, or non-compliance with provided instructions. The Company is not liable for indirect damages that may occur due to errors in product usage or delays in delivery. Our liability to you is limited to the amount corresponding to the product’s purchase price.

9. Changes to the Terms

We reserve the right to make changes to these Terms at any time. Any changes will be published on our website and will take effect from the date they are published. Changes to these Terms will not affect orders placed prior to the publication date of the changes. It is your responsibility to stay updated on any changes to the Terms.

10. Force Majeure

A Workout Company AB is exempt from liability for failure to fulfill certain obligations under this agreement if the failure is due to circumstances beyond our control and if these circumstances prevent, complicate, or delay the fulfillment. Examples of such circumstances include government actions or omissions, new or amended legislation, labor market conflicts, blockades, fires, floods, sabotage, major accidents, or other types of natural disasters. Force majeure also includes government decisions that negatively affect the market and products, such as restrictions, warning texts, sales bans, abnormal market decline, and criminal activities that impact business operations.

11. Disputes

In the event of disputes arising from these Terms, we will primarily attempt to resolve the dispute amicably. If an agreement cannot be reached, the dispute shall be settled under Swedish law in a Swedish court.

12. Cookies

The website www.aworkoutcompany.com uses cookies. Cookies are small text files stored on the visitor's computer that can be used to track the visitor’s activities on the site.
